Alito (Bush) was nominated in Bush's second term, where he won the popular vote -- although one could argue the huge incumbency advantage derived from being president while losing the vote count makes it 5 of 9.

This inequity persists with Constitutional Amendments, where 38 of 50 states are required. Factor in gerrymandering, a filibuster that isn't in the constitution (and the founding fathers "contemporaneous writings suggest views that ranged from ambivalent to negative about the value of delaying tactics in general"), and lobbyists, and it's hard to think of an advanced country with a worse democratic framwork.
