    STATE OF OKLAHOMA
    2nd Session of the 51st Legislature (2008)
    HOUSE JOINT
    RESOLUTION 1089 By: Key
    AS INTRODUCED
    A Joint Resolution claiming sovereignty under the
    Tenth Amendment to the Constitution of the United
    States over certain powers; serving notice to the
    federal government to cease and desist certain
    mandates; and directing distribution.
    WHEREAS, the Tenth Amendment to the Constitution of the United
    States reads as follows:
    "The powers not delegated to the United States by the
    Constitution, nor prohibited by it to the States, are reserved to
    the States respectively, or to the people."; and
    WHEREAS, the Tenth Amendment defines the total scope of federal
    power as being that specifically granted by the Constitution of the
    United States and no more; and
    WHEREAS, the scope of power defined by the Tenth Amendment means
    that the federal government was created by the states specifically
    to be an agent of the states; and

    WHEREAS, today, in 2008, the states are demonstrably treated as
    agents of the federal government; and
    WHEREAS, many federal mandates are directly in violation of the
    Tenth Amendment to the Constitution of the United States; and
    WHEREAS, the United States Supreme Court has ruled in New York
    v. United States, 112 S. Ct. 2408 (1992), that Congress may not
    simply commandeer the legislative and regulatory processes of the
    states; and
    WHEREAS, a number of proposals from previous administrations and
    some now pending from the present administration and from Congress
    may further violate the Constitution of the United States.
    NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES
    AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:
    THAT the State of Oklahoma hereby claims sovereignty under the
    Tenth Amendment to the Constitution of the United States over all
    powers not otherwise enumerated and granted to the federal
    government by the Constitution of the United States.
    THAT this serve as Notice and Demand to the federal government,
    as our agent, to cease and desist, effective immediately, mandates
    that are beyond the scope of these constitutionally delegated
    powers.
    THAT a copy of this resolution be distributed to the President
    of the United States, the President of the United States Senate, the
    Speaker of the United States House of Representatives, the Speaker

    of the House and the President of the Senate of each state's
    legislature of the United States of America, and each member of the
    Oklahoma Congressional Delegation.

                  is anyone from denver?

                  i remember back in 2005 or so, the city of Denver voted and passed a resolution that decriminalized the possession of marijuana. The people voted, and the city complied. To everyone's dismay, all other bureaucratic organizations stepped in and tried to pull rank. The city of Denver was a part of w/e county, was a part of CO, was a part of the US, ... The effect was the the state and county police enforced the laws instead. Thereby disenfranchising a good percent of their population. I don't know how this turned out exactly, but it gave me little hope that anything done in the name of progress on a local level will ultimately be reverted by federal authority.

                  I also noticed that it doesn't specifically address any piece of legislation, just says that all blah blah blah not in the constitution blah blah haven't followed it for 100+ yrs blah blah blah federal gov't stronger than states for 100+ yrs blah blah blah

                    That's always been a contentious issue. I think as far as drug policy goes it falls to federal authority but regardless anyone above will pull rank in the name of public morality. I think it shouldn't personally because when it comes to drug policy local and state levels are better equipped to deal with it, local communities can decide for themselves. A hard line top-down policy does little to help people stuck in a cycle of addiction. In some ways I think it's also good for gun control. Applying the same set of laws and ideas of say rural Kansas to downtown Chicago is going to fail to serve the public interest. As for seceding from the United States I think only Texas can legally but it's probably more of a political stunt to show their dissatisfaction with the current Administration.

                    Edit: And on that note why in the living fuck is Bush in London with Brown firing off rhetoric about Iran when oil is pushing 140 pb? We need to flush this turd and be done with it.

                      what state hasn't wished to secede from America? I'm kind of curious to find out how many states have wished to declare themselves sovereign. I've got ten bucks on Maine wishing to be part of Canada.

                        i'm pretty sure they gave back the part of canada the took by force in 1812, but then again, i'd call most new engladers pussies anyway (just to see what they'd say back)

                          In a joint resolution, the Montana politicians argue that when Washington approved the state constitution, including a clause granting “any person” the right to bear arms, upon the Treasure State’s entry into the Union in 1889, the federal government recognized that clause as consistent with the Second Amendment. If the Court comes down on the side of a collective right, they argue, it would breach the compact for statehood between Montana and the federal government.
