      When the DEA raids the homes and establishments of elderly, chronically or terminally sick people using the drug (which the President has agreed to stop, hopefully he sticks to it) to manage pain and given the fact that according to the FBI possession accounts for 80% of drug related arrests, while weed accounts for 50% of those possession arrests (not counting sales/manufacturing/trafficking) AND that on average 1/3 of misdemeanor soft drug offenses like marijuana result in at least 1 year jail time and a 2,000$ fine, and that possession is on par with sentencing and convictions for aggravated assault, and that misdemeanor drug offenses account for a vast majority of arrests shows that it's not always a slap on the wrist and it is clogging the criminal justice system putting non-violent people in jail, where they can become more violent, make more connections and enter the revolving door.

        Umm, Possession of Marijuana under two ounces unless sealed in seperate baggies with the intent to sell is a class B Misdemeanor.

        Sec. 12.22. CLASS B MISDEMEANOR. An individual adjudged guilty of a Class B misdemeanor shall be punished by:

        (1) a fine not to exceed $2,000;

        (2) confinement in jail for a term not to exceed 180 days; or

        (3) both such fine and confinement.
        Rarely do you get the maximum fine. Like I said I was arrested for weed when I was 17 (legal adult in Texas) and was charged with a class B misdemeanor, had to have a lawyer appointed to me at the time and got off with 20 hours of community service and court costs. Very rarely if ever do you on your first offense with marijuana unless you are obviously going to be distributing it go to jail for marijuana. Of course I am sure that as a Canadian you have better information than me about this.

            My information says 1/3 of cases result in jail time up to 1 year. Both of us have the same access to information and being suburban white kids we deal with the same environment and the same problems. I stand by my point that it is diverting resources and personnel from all agencies and the justice system which should actually be going after harder stuff and the elements that come with the black market.

                ive been pulled over twice with weed and we wre smoking blunts......there was no denying we had weed in the car and if ur honest with the cop they will most likely treat u right and just take ur shit and make u watch them smash it into the ground with your feet or they even make u do it.

                  I am talking about on average nationally, below 100 plants it is not considered a federal crime, below 2 pounds it is not a felony. For misdemeanor offenses my information is correct. I didn't say Wark's figures were off or wrong, he was quoting the Texas penal code while I was looking at Federal and National stats for drug offenses.

                      you be imprisoned UP to a year here, not more for first time possession, though the avg sentence is probably a month. possession with intent to sell (aka just owning a scale or holding two or more bags) can get you up to 5 years here. so please, stfu, he's not too far off. in some cities they wouldn't even take you to jail for the night, but the fact remains that there are quite a few places around that keep smoking a joint on par with assault. he has better information than you because he's having to look at the US as a whole, and you're just looking in your backyard.


                      EDIT: don't forget about the Michael Phelps bullshit too. All they had on him was a photograph and they launched a full-fledged investigation that led to search warrants for multiple addresses and 7 arrests all over a grand total of six grams of pot. That's less than a 1/4...

                      there are tons of cops who relish on fucking people in the ass on stuff like this, because it gives them a "holier than thou" feeling of superiority.

                        Is someone really trying to tell me that Texas of all places, the leader in sentencing people to death is really that much less harsh about people with weed than the US average? People don't really go to jail for weed, but at the same time you pay a shit load of money for court costs and fines that is how they make their money off weed being illegal. The people you read about who go to jail for weed either have an insane amount of weed, have been caught multiple times with weed, had pre-packaged weed ready to sell, or were complete dickheads to the cops in which case they deserve what they get.

                        And as for Micheal Phelps they had to go hard on him, he is an Olympic Athlete who millions of kids look up to and here the dumb ass is on camera doing drugs. So his punishment is less about smoking weed and more about being a fucking moron and letting himself be taped smoking weed. How would you feel if you had a kid who looked up to this guy for winning all these gold medals, got interested in swimming because of him, and then watches the guy smoking weed on camera? He deserves what he gets and they are pretty much forced to throw the book at him.

                              1st- there are plenty of people in jail for drug crimes, if you don't believe me then look at the NIDA website and figures. it isn't zero. 2nd- guess what happens when you can't afford to enter into pretrail programs, like a lot of minorities, you go to jail. Also, like money's mentioned many times you lose your license for 6 months. That's going to get you fired from a lot of jobs. And by the way, I'm not reading about the people, i'm talking to them in person.

                              As for Phelps... they didn't have to go after him. In fact, the local college police and the city police said it wasn't worth their time. it was the county police who decided to waste the time on it. And they didn't arrest him (they couldn't even if they wanted to) they arrested 7 other people who just happened to be in the house where the party happened. They got a warrant to search their properties, showed up with a dozen officers with guns drawn, and took all 7 to jail over less than a quarter of pot. They had no legal recourse to pursue Phelps-- being photographed with a bong isn't illegal. They had shaky reason to get search warrants for people who weren't even in the photo. They had no reason to barge in with guns drawn. they had no reason to pull the "hand of one is the hand of all" law and arrest all the people.

                              they probably won't go to prison after all is said and done, but going to jail isn't a slap on the wrist. maybe it doesn't matter to you because your resume is going to have plenty of other detractions, but most people will suffer greatly from even having to spend a night in jail through loss of employment, fines, and DL suspensions.
