      Know why those warnings are there? One of two reasons: 1) They got sued and now do it to say "we told you so", or 2) they're preemptively covering their ass. For what? Am I too fucking stupid to realize that coffee can be hot? Am I too blunt-headed to realize that ovens are indeed not a good place for a 3 year-old to nap?

      We sue, and we sue, and we sue. It's not The World vs. the US, it's just plain fact.

      EDIT: Just to clarify, I don't really care what you do. But I agree with DTF that the most sane course of action to me seems to just get your car (and yourself) fixed with insurance money, and unless you're more injured than you've let on, let that be it. The guy was drunk, he got arrested, and he's going to be in twelve metric shit-tons of legal and money trouble. Unless he also fucked your mother, then karma is already reaping it's comeuppance.
      So does this mean plastic bags are for anal application?

                  I hate people that can't take a substance of any sort in a safe and controlled environment. I understand people sometimes don't have control over themselves under an influence... that's why you do so before.

                        Ok so here's the deal. I spoke with a lawyer and dug around a bit on my own.

                        My insurance, Geico, is only responsible for repairing the vehicle back to the condition it was in before the accident. There will be frame work done, so thankfully my dad will be there when the adjuster goes to the dealership to determine the work that needs to be done. There's a lot of ways they can skimp on the work for the frame - i.e. covering up the damage, not replacing damaged parts, etc.

                        Afterwards, I will have the car appraised. There is this thing called "dimished value" for a car that needed major repairs, which basically means that it's trade-in/resale value is down the shitter because they record the repair amounts and it's visible on carfax. This is something not covered by my insurance. There is no law stating insurance companies are responsible for "dimished value" because it varies between appraisers. But at the same time, I am entitled to the "true value" of the vehicle before it was in the accident.

                        So here's where the lawyer comes in. I COULD do this myself and set up a claim (either with the DUI driver's insurance, or the driver of the car in the left lane... not sure how this works) for the dimished value after I get the car appraised - then sue if I don't get this amount, or I can hire mr. fancypants and have him lay down the law for me. In any case I hope to get some money out of this because I originally wanted to trade this car in for an SUV.

                            I hope you went to the hospital to get yourself completely checked out, even if the only visible injuries you have are glass cuts.

                            I've known a few people who've had severe post-accident complications months after the accident because they thought they were fine at the time.

                              Agreed with Sal, at work I handle "things" for an insurance company, so I have to read through medical reports every day. There's a shitload of instances when people have noticed serious injuries (especially around the neck/whiplash) way too late.

                                You have a claim but you probably don't need to sue. I would gather up your medical bills and any other documents related to the loss and contact the insurance company for the at-fault driver to see if it will settle with you for a reasonable amount. If not or if you have on going problems, I suggest you contact a lawyer.
