Arguably, since if you're coming from behind them, they still have a while (compared to you, at least) to turn and/or shoot, and even if they just start moving, if you're behind them, they won't stand a chance anyway, from a standing start. (If you can shoot, that is.)

However, this poses the problem of "Okay, I'll not fire since they just spawned." - Then they shoot you anyway, which is perfectly logical, since kills mean points. Obviously this matters less in pubby than in DD's. In DD's it seems to be pretty much... "Spawnkills happen. Bad luck, old chap."

Spawns = Easy kills = Points = Teh win.

Now, after the fairly pointless rant, the conclusion which is...

It's situational, in my opinion.

if they move to try to get away from you and you kill them a split second later, its still a spawn. If they shoot at you first then you kill them, then i guess its all fair.

I don't really care about this, but as long as other player don't get point for killing the same person twice in like 10-15 seconds if that's right.

I spawn everyone (excluding folks that im cool with) the reason being is> on the occasion that I show mercy and fly past, I get shot in the back> therefore I spawn everyone basically. I may be an ass but it works for me.
