So if the reason personal fines can be raised to maintain an "equal" level of punishment, then why keep the same rationality and allow lawsuits in the millions so drug companies feel punishment no matter how big they are? Incidently the finnish traffic code only came to my attention because of an article a while back about a man who was charged much more for a speeding ticket than the guy in the liver pills suit is asking for. I doubt that individual has a greater net worth than the drug company in this article.

If you apply that reasoning on a broad scale, what is the incentive to be sucsesfull? Why inovate or work hard if the government will scale down your slice of the pie at the end of the day to match the average? Arguing the merits of socalism bordering on communism isn't the topic, so i'll stop.

Just few points,

a) speeding is intentionally breaking the law, thus you should be punished

b) the dude was given a drug that saved his liver, too bad it had a side-effect that was unknown and turned him into white. The drug company didn't purposefully turn the guy half-white. Thus the man should be compensated for this unfortunate incident instead of the company being punished for saving his liver.

If you dont see the difference in a and b, well too bad.

c) You feel its not worth getting rich because you would get fined more when breaking the law? okay

It's surely better to live than to become white, however, where he lives it looks like turning white has many consequences like getting shunned, so I can understand if he's pissed off.

You know the guy in that picture doesn't look like a black guy at all. It just looks like a white guy with a rare skin disease which puts spots of black pigment all over your body. You may have seen this before, I have seen it a few times just from people on the bus. It's an actual medical condition, but since I don't have my dermatology notes with me right now, I can't recall what it's called.


As for lawsuits... in Canada we also don't have punitive damages, only compensatory damages in lawsuits (either that or punitive is limited to the scope of punishing for just 1 person instead of punishing for every potential person and giving all that money to 1 person like in the US... I'm not a lawyer I forget). I remember talking to a few law students about this once, and no one could really agree which system was better.

One compromise was perhaps to punish the company and have the punitive punishment go towards the government, but then the question arose to whether this would give enough incentive for someone to sue, especially when they are risking a lot in legal bills and their compensatory damages might not be all that much. Either way it's a very complex issue that cannot be debated properly on the Trench Wars message boards because I doubt we have knowledgable enough people here.
