Personally, I think the cop had every right to shoot, and should not be punished. Afterall, he shot the guy in the leg, and had no intention of using lethal force.

Oh, the article doesn't talk about the fact that they're probably going to take away the cop's badge, and the victim is thinking about suing. It's been all over our local news.

hmm, I forgive him for mistaking his weaponry. Shit happens. But if the guy is crazy or drunk/high whatever, should be left alone if he wants to be in the tree. Don't see why cops/people don't leave other people alone if they want to do whatever they want (here's an edit)That's not illegal . When was it a crime to chill in a tree. If he's going to hurt himself then let him hurt himself, you're not his mother. I'm pretty sure if you got a mind, you would avoid him if you think he's going to jump down on you. Honestly, people are enforcing rules and violations and whatnot that may not be written down some where, or is not looked at that much. It's getting annoying. People just needs to chill. If you get uptight and shit, you're just going to make the violaters worse.

It's part of simple weapons training to check and double check what you're firing at, what you're firing with, and the environment you're firing in.

When you're pointing it at another human?

Sure, he made a mistake. But this isn't like he got the wrong kind of milk at the store. He shot a guy, for no reason other than incompetence.

If you try to talk him down for two hours, you're telling me, you can't spare the extra second to double check and make sure you're not pointing your GUN at the guy?

And I own guns! And I'm a gun ownership advocate! And I've taught people to fire guns! This is operator error. His fault.

Okay, I just realized the article does a terrible job of describing what really went down. The man, who was intoxicated, climbed up a tree on private property. This wasn't some tree in the park, he climbed a tree in a family's front yard, and began talking to himself. The mother, who was alone with her children, went across the street to the mechanic's to ask one of the larger, more scary fellows to get him down. When the mechanic tried to get him down, the man became "hostile", at which point they called the police. The police also tried to get the man down, only to have the same result, and thus opted to taser him out of the tree. The cop in question apparently grabbed his gun accidentally (riiiiiiight) and fired a shot into the man's leg, at which point he voluntarialy came down.

Alright, I understand that he should be admonished for the mistake, but taking away the cop's badge and livelihood? Especially since the shot wasn't fatal, and was intended to be a leg shot? I don't think he made that major of a fuck up.

That clears things up a shit load better. Climbing up some random tree and sitting there is one thing, but climbing up someone's tree in their backyard (or frontyard?) is another. Like Sarien said. He had plenty of time to check. Unless it was real dark out, and/or he got real nervous.

Man, that's a difficult situation to arbitrate. Obviously, the cop should be punished, but I'm unsure if permanent dismissal from the police force is warranted.

But on the other hand, if you're the kind of person that makes these kinds of errors under intense pressure and scrutiny---you probably shouldn't be a beat cop. At the very least, the guy should be assigned to desk duty and intensive re-training. Or maybe he should be a plumber, or doing something where making a mistake doesn't involve life and death situations.
