So, I'm driving to work today, going 40 in a 25, and I get pulled over. I'm like oh fuck, because I was totally guilty of speeding. Well, the cop comes and asks for my license and registration, to which I comply. Then the officer asks if I've been drinking, or if I am under the influence of anything. I answer with a no, and he tells me to get out of the car with my hands up. Again, I comply, and he has me take a field sobriety test. I don't think I failed, because I was able to recite the alphabet backwards, walk straight, and follow his fingers.....oh, and because I hadn't had anything to drink all day, and I surely wasn't under the influence. Anyways, he asks me to put my hands on my hood, and he begins handcuffing/reading me my Miranda rights. At this point, a second cop shows up and begins talking with the other cop over by their cars, all the while I'm still handcuffed on the hood of my car on the side of the road. The cop comes back, and tells me he's writing me a $670 ticket. I ask, "What the hell for?" He tells me that I was speeding in a school zone, which I wasn't, just for the record. I make the argument that school's out, and thus that law isn't in effect, to which he tells me that it's always in effect (I looked it up, and that's not the case.) Anyways, I ask him if I can call my work to let them know I would be late, and he says no. Then, I regretably say, "Why are you being a prick about this?" BIIIIIIIIIIIIIIG MISTAKE!!!!! Next thing I know, I'm in the back of his car on the way to the police house, where I'm booked and put in jail for about an hour, at which point I finally get to call my work, and my mother to tell her where I am. She shows up, pays $200 to bail me out, and net thing I know, I'm being charged with harassing a cop and public indecancy (neither of which are felonies, thank god) but I now have a criminal record (FUUUUUUCK) I owe my mom $200 bucks, and I'm going to have to pay a $670 ticket.
But, I've been reading up since I got home, and it turns out my ticket should be halved, and that I can sue that police officer for harassing me. Furthermore, since I did not make a threat at the officer, I can't be charged with harassment, and am actually protected under the first amendmant to say what I said.
I can't erase that record though, and we all know what happens when you sue a cop....:/ Judges don' like to punish one of their own.
Basically, I'm screwed. God bless America, and our freedom of speech.
