in south carolina, where i was ticketed for minor in possession of alchohol (while standing in line outside a bar) and for possession of a fake id (was dumb enough to give it to a plain cop guy who looked like a bouncer) by the University of SC AET (alcohol enforcement taskforce) in june while i was 20.

DO NOT PAY THE FINE UNLESS YOU ARE SURE YOU WON'T LOSE YOUR LISCENCE.

If a minor (under 21) is charged with an alcohol violation, you lose your liscence for 6 months or untill you're 21. It may be different where you live, but don't assume you can just "pay the fine". Also, you'll lose any state funded scholarships if you get a drug/alcohol charge.

Yes, you won't find a lawyer who'll represent you for free (and you don't need it for magistrates court), but you should be able to find free advice.

I've been there too, don't risk losing your future (it takes 6-7 years to expunge your record) for a simple fine if you can avoid it.

We have ADP (alcohol diversion program) which i think is probably just for SC. After that we have the usual PTI (pre-trial intervention).

These programs might cost you more than the ticket (they did for me) but it'll save you thousands in scholarships, won't go on your record, and will allow you to continue driving legally.

THE LAWS MIGHT BE DIFFERENT FOR YOU THAN FOR ME, BUT THEY'RE ALSO PROBABLY DIFFERENT FROM EVERYONE WHO SAYS YOU CAN JUST PAY THE FINE AND BE SCOTT FREE.

edit: i had my case continued twice (2 months after it should've been) and it was the last case heard that day. the cop was the only person besides me waiting in the courtroom 3 hrs later.

First, never consent to a search. I don't care if you have a gram of blow hanging out of your nose, don't consent. You don't win any points by doing so, and you can only hurt yourself.

Second, the cop most likely will say he has probable cause to search your car anyway once you refuse the search.

That doesn't make sense..how can he have probable cause to search just because you refuse the search? That renders that entire amendment useless.

The cop would have had probable cause to search jeromes car because Jeromes friend was probably acting sketchy around the Cop, or like jerome said, they were buddy-buddy until a certain point, which means he probably looked into one of dylan or devoncie's eyes and saw they were high.

Wow, you got lucky and you handled it with balls of steel. However, I would not have talked to the cops at all. When he asks, "so where is the pot?" you can either lie, tell the truth, or say nothing at all. A lot of people only assume the first 2 options, I guess. I have never been confronted by a cop for anything like this, but it is a possibility ^-^ so my policy will always be to say nothing to cops. They are trying to bust you and they are good at it; if you start talking, they can easily manipulate you.

Whether you consent or not does not factor into reasonable cause for them to perform a search. Gen is right.
