STATE COLLEGE — Two concession stand workers in town for the Grange Fair provided information that led police to arrest a third person in the year-old homicide of 29-year-old Samuel S. Boob.
Friday night, police arrested Kermit Thomas Butts, 26, of Madisonburg, on charges that he knew his co-worker and the victim’s wife were planning a crime, drove the man accused of shooting Boob to and from the scene, and kept it all a secret for exactly one year.
The victim’s wife, Mirinda Boob, and Ronald Heichel, of Bellefonte, were charged Aug. 27, 2009, with the crime. Police said Heichel lured Sam Boob into his own garage, then shot him twice with a shotgun.
Boob died immediately in the driveway of his Tusseyville Road home.
Police have charged Butts with aggravated assault and hindering prosecution, saying he witnessed Heichel and Mirinda Boob planning in the days leading up to the shooting, knew they were having an affair, and never told police that he heard two shots ring out after dropping Heichel off near the Boob house.
Butts isn’t the first person police said had advance knowledge that a crime may be committed.
In October, police said Centre Hall man Wesley Decker admitted he talked with Mirinda Boob last summer about how to load a shotgun and counseled her on guns “and the disadvantage of Samuel being killed within the family home,” court papers said.
Decker, who was having an affair with Mirinda Boob, also told police he purposely didn’t call Mirinda Boob the day of the shooting because he knew “something would happen to Samuel,” police said. He hasn’t been charged.
In 2008, police said Mirinda Boob had an affair with a man police haven’t named, who later told investigators their relationship ended because she wouldn’t quit talking about how “easy it would be to just have (Sam Boob) killed and make it look like an accident,” police wrote in search warrants for Mirinda Boob’s phone records that were filed in county court in October.
When police questioned Butts last week, he told them he first met Mirinda Boob at the Snappy’s in Centre Hall, where she told Heichel that her husband “abuses her.”
Butts — who worked with Heichel at Garbrick’s Amusement in Centre Hall — told police Heichel responded that “he could take care of that and that he could kick his ass,” court papers said. Shortly after, Mirinda Boob and Heichel began having sex and spending time together in his bunkhouse on Garbrick’s property, according to court papers.
Butts told police that in the days just before the shooting, he twice drove Heichel to a spot on state Route 45 — near the sign for Penn’s Cave — where Heichel and Mirinda Boob met for several hours.
After one of those meetings, Butts told police Heichel offered him $5,000 from Sam Boob’s life insurance policy if Butts agreed to help get rid of the body.
Heichel told Butts that Mirinda Boob would be “coming into a large sum of money ... once they got rid of Sam Boob,” police wrote.
Police don’t reveal if Butts agreed, but court documents allege that Butts knew Sam Boob’s life was in danger when he dropped Heichel off near the Boob home around 6 a.m. Aug. 23, 2009. About four hours later, Butts said he picked up Heichel, who was “all sweaty and had different clothing on,” court papers said.
“Once Heichel got back into the (Garbrick’s) truck, he advised Butts that he and the victim became involved in a fight and he shot him and killed him,” court papers said. “Butts drove Heichel back to the bunkhouse in Centre Hall.”
This came to police attention Wednesday, when H&C Concession workers Michael P. McDaniel and Thomas C. Holloway returned to Centre Hall for the Grange Fair, and told police that on Aug. 23, 2009, Heichel and Butts were acting strange and “hurried” back into their bunkhouse just as they heard police cars and an ambulance driving to the homicide scene.
After his arrest, Butts was taken to county jail on $100,000 bail, set by District Judge Carmine Prestia.
Heichel’s attorney has said in the past that evidence shows it’s more likely that Mirinda Boob tried to pin the shooting on Heichel to cover for herself, while her attorney said Heichel shot Sam Boob without her knowledge.
