Okay..

well i dunno how many people know but i just got banned for a week..

what i was doing was using kazaa movie downloads as a method to give myself a lag which made me perform better in trench wars

now sometimes it works, other times it doesn't

but the point is that i was using it today and i started lagging and i kept playing and a lot of players were angered by my actions

but the thing is... the reason i kept playing was because i knew it was legal... i was told by people that the lag i had i could not achieve from kazaa.. but i did

and had a mod told me to stop it i would have

i even contacted Thorn and Left_Eye <ER>, and asked them both to check my lag and see if it was okay to play, and they both said it was fine

and i was playing in a tournament and i did good cuz of the lag, reason i kept it goin was cuz it was fun

i wish a mod had just said to turn off the downloads... but instead people just got offensive and got me banned

i can understand that you guys are mad...

fireballz, topgod, dark!, gundam, mineral, overstrand, flabin, epinephrine, anyone else i may have angered cuz of my lag... i'm very sorry....

i guess your opinions of me are just quickly turned by some lag

but seriously i wasn't cheating.. i know the lag looked like cheating but i'm just going to take the ban since i know i deserve it.. i didn't use lagtronic or a cheat program, but i did use kazaa to lag, and that's just as bad i guess, so whoever it was that banned me had good reason i suppose...

once again.. my apologies, i'm not gonna be dumb enough to use kazaa again, that's for sure

i play with kazaa all the time and I don't get banned all the time. I play normally with nothing open in the background And I still lag. I play with kazaa.. Imagine the lagginess in that?!?! OH GOD PLEASE BAN ME FOR I LAG SO MUCH....

The point here is intent.

He opened Kazaa and downloaded large files with the intent of producing lag, which in turn helped him perform better.

I'm amazed he still tried to weasel out of it by saying he wasn't cheating just because staff couldn't come up with factual evidence to ban him with (which apparently they just did).

That's like a guy suing Viagra for giving him a boner.

I'd agree with Annux on this one. Technically there isn't a rule against the exact thing that eRad did, but it all fits under the rather large category of moderator discression.

Either way he had more or less actus reus (guilty act - intentionally lagging) and mens rea (intent - he admitted he did it) which is enough to get yourself punished in a court of law if there was a law against it. Since there was no law/rule here except for the moderator discression (I mean c'mon TW with lawyers would just be silly =) ) I think 7 days might of been too harsh, but hey I didn't ban him!

And eRad no need to be sorry to me, I was not angered by your lag, I didn't even play in the tourney nor did I watch until the last 30 seconds.

well when i had the downloads on they lagged me

the purpose of me saying i used kazaa to lag was just to inform you of the CAUSE of my lag

kazaa lagged me, not lagtronic or whatever else i was accused of

i downloaded movies for the sake of downloading movies, the resultant lag was a coincidence

if a mod had told me to stop my downloads i would have, but instead i was just banned immediately

again i remind you that i asked Thorn and lefty about my lag and if it was okay for me to play.. and they both said yes

yah but epi... he knew it was a bad thing to do [malum in se] even though there was no rule prohibiting it [malum prohibitum]. The ban was rightful.

Exactly, it isn't a clear rule. I myself have never heard "It is illegal to download programs while playing Subspace because it will make you lag." I know eRad downloads a lot of movies. He wasn't downloading them so he could lag. He had been downloading them before the tourny because he wanted movies. Not so he could lag and win ez. eRad doesn't need lag to win.

All eRad said was that he was lagging and since Left_Eye and Thorn said he could play with his lag, he figured there was nothing wrong with it. That is the same thing I would of done cause I don't see that rule anywhere (It is illegal to download programs while playing Subspace because it will make you lag). What makes me even more mad is that people were saying he was using lagtronic when he was not. And that he was banned for "using" lagtronic. The mods who did ban reworded what happened. I saw that from looking at the log. Also, its funny how the people who were losing to him were the ones who reported him except for TG and Gundam but they both hate eRad. You can't just ban someone because they are downloading programs and its making them lag. Since it's not a clear rule, we should atleast warn, but that didn't happen...cause everyone just jumped to conclusions cause they were mad they were losing and started making up false info.

Now some of you may be thinking, GK, you fatass farmer (which im not), you're just defending him because he is in your squad. eRad is a pain to me sometimes, he jokes around with me about the farmer situation that Amorphus made up. I am just disappointed with how this was handled.

I agree that doing something to make you lag isn't right, but, he was downloading movies before the tourny. He even admitted it! Do you think he would admit it if he knew you aren't suppose to make yourself lag or you will be banned? NO, most people would do the same. He said he was downloading movies because he wanted them and he saw that it lagged him and didn't want to turn them off because the lag helped some. He first should of been warned but he wasn't. I've seen people lagging because they were downloading. I never thought anything about it. I even download things while I'm playing Subspace. It makes the download seem to go by faster when you're doing something. I don't do it to make myself play better.

I think after this situation, there needs to be a for sure rule stated about lagging from things your downloading since that is said no where. This ban should be lifted or atleast decreased in the amount of days.
