What he means is that the peer to peer software itself is not illegal. Therefor kazza can't be sued for illegal use of their software, the people sharing can be sued.

But buying rifles is legal, downloading songs isnt. Thats an important distinction. If the metal work made a rifle that was illegal (especially powerful) then yes he will be countable.

peer-to-peer software is NOT illegal. the software can be used to distribute non-copyright material just as easily as it can be used to distribute movies and mp3s. for that reason, the only "guilty parties" are the people who distribute illegal material using that software. if you'd ever bother reading the license agreements of the p2p service you use, you'd see something like this:
Kazaa makes no representations or warranties regarding the files downloaded by Kazaa's users. Copying or distributing unauthorized files may violate copyright laws. Compliance with the copyright law is solely the user's responsibility.
in other words, you do what you want at your own risk. if you get caught, the company can't be held accountable. you've already agreed to this and all of the other legalities in the disclaimer.
