If he went to jail, they would've put him in an area where inmates go when they're considered to be unsafe in the general public, there are only 21 people in that area and they are safer and have a little more freedom than the general population.

I believe when he says sleeping, he actually means that state where you lie, immobile and with eyes closed, possibly snoring. Actual sleep. He's a weird one. And he never admitted to having sex with them. A less rich man wouldn't have got off. But not MJ.
