It's funny how society says that when drinking you take full responsibility for what you do in your poor judgment when you are drunk, and on this issue they are going the other way. It technically is rape though. When I was at Tulane, there was an article in the school newspaper about a dude that got arrested for rape because there was a hurricane coming, the guy and the girl smoked a bowl, and the girl was so stressed out from the hurricane that she said she wasn't able to render consent. I think the guy got off, but anyone who has ever smoked weed or been stressed out knows that neither of those things would ever render you incapable of knowing whether or not you wanted to have sex with someone. The poor guy showed up the next day to hang out with the girl and the police were there and they him.

Obviously you shouldn't bang someone for the first time if they are stumbling, slurring words, etc, and you're not, that's rape. But even if you can't tell that someone is intoxicated, you can still be charged with rape for sleeping with them. What I don't understand is why it's so gender biased. If I got wasted and hooked up with a fat chick that was sober, I couldn't charge her with rape even though it's the exact same thing.

I don't want to get into an argument about whether or not my story is factual, but I never once said that they were drinking. He might have been, he probably was because he always is, but she was 100% sober.

Well, that's different too. If someone says no and they're fucked up (hell, I'd count stoned), you don't try to convince them to sleep with you. My problem is if they NEVER say no, and are always into it, why the hell is that rape if the parties are equally intoxicated?

I know this guy that raped a girl I know. I was friends with both of them. To this day he claims it was consensual. She tried to press charges but didn't have enough evidence to win the case.

So what did we do? First, obviously, we cut off all contact with the guy. Then, we talked to all of his friends about what he did and even though they didn't know us, they knew her (most of them did) and then cut him off. The result? Now everyone who knows him knew what he did to her. Whenever he starts chatting up with a new girl, someone kindly lets her know about his past.

Is it mean? Yea. Is what he did to her? Even more so. We damaged his reputation - the thing he most prized, seeing how vain and self-centered he was (most abercrombie models are) - and now he's stuck with the guilt of what he did and basically no friends.

As for the girl, I can give you the perspective of what I would want if I was in her situation. I would just want someone to talk to whenever I was feeling extra depressed about the situation. It's really the thought that counts. Saying that you're going to beat the guy up wouldn't make me feel any better, because girls have a protective instinct. Even though the guy did that to her, deep deep down she wouldn't want him possibly dead and the person who is there for her to talk to in jail.

So basically - summary of this post if you didn't want to read it - damage his reputation and just be there to listen to her.

seeing how there wasnt enough evidence? that means she was not raped. if she was raped she would have gone to the hospital gotten some tests done and proved she had been raped and then a police report and yes thats enough evidence especially when u know who did it

I agree with you on this but the rest is kind of stupid, some women can't be trusted and will claim rape just to get back at the male. Real rape isn't funny, but these type of cases just blow my mind, considering someone who is raped has CLEAR indications and signs that they were raped.

When it comes to human to human we only care about relatives; family and peers. You can pretend to care about anything else, but that's more out of courtesy, there are no real lasting emotions involved.

I promote laws that protect my family and friends which in tern helps other people's family and friends. I care about people, regardless if you think it's out of courtesy or not.

I regret ever being associated with half the people I knew, and the majority of those were bitchy girls who probably be the same people to call rape after letting a guy fuck her at a party. I went back to High School a year older and started hanging out with a more popular crowd than I was use to and pretty much got a lot of ass and a lot of drama over the whole ordeal.

I've been called a user two times during the past two-three years and these were from some of the girls I use to hang out with. I first hooked up with a friend when I was on a break with my girlfriend and told her we broke up a few days ago and we started fooling around and I told her I wasn't sure if I was ready to go right back to a relationship but I wouldn't mind going on a date. A week later things work out with the girlfriend, she told everyone I used her and knew that I would end up going back to my girlfriend.

The second time was on my 18th birthday when I was at my friend's cottage and I made out with a friend who first kissed me which lead into cuddling the rest of the night. When we were about to go to bed I told her that I couldn't sleep with her because I'd want to kiss her and be close to her and she said that's fine. The next day everyone treated me like I did something seriously wrong, and she refused to talk to me.

Both times that might have lead to sex would result in me getting accused of rape, why because the girls are douchebags and I didn't know it at the time. The first girl claimed she was all Christian and shit and now sells weed and fucks constantly, except she said she'd wait to marriage, I guess those Christian ideals went out of window. The second girl goes to Western University and had sex the first week she was there but doesn't remember who the guy was, she was pretty upset about it. The second girl also has a drinking problem and she'll come out of University looser than a wizard's sleeve.
