That's the point. The law is not immutable. What matters is that it allows for morally and ethically questionable actions and it's not in line with other legal documents so it should be changed, and not only at the willing of the masses. He's off the hook but the debate on this has to be advanced so we can hone judicial and legislative processes so we don't have people shooting each other in the streets legally.

The people of Texas reflect their "morality" through the law they institute. Apparently property is a big deal down there so they choose to protect it. If they want to change it later then a review will be scheduled and eventually it'll be put to a vote.
