Today I got my first non-traffic citation/summons. I've never had to appear before a "District Justice" before, so I guess I'm looking for a few tips on how to get out of this scott free.
What happened:
I came back from the Penn State football game (we won vs. OSU), it was also the night where my roomate had a party for his gf and another friend, but it was more of just a weekend party.
This was our first party this semester, where we had the music on so loud.
I came back around 12:30am to find that no one was there yet. (the game ended at around 11:15, and people were still getting out of traffic) and my roomate told me to get some juice for the drinks. The music was already on at this point. I went to walmart, got the drinks, came back.
5 minutes after I mixed the jungle juice, 2 police officers came by at first. The first one told me to turn the music off. I replied by saying "but we signed a copy of--" and the second police officer put his hand on my chest and pushed me into my living room, and shouted at me to turn it off. At the time I realized what I said applied to my last apartment complex.
I unplugged the stereo. I had one roomate with me at the time (out of 4 people total, not the one who wanted the party) who also just got back from the game. The first officer wrote us both "undefined" citations for disorderly conduct that could be up to $300. He said the minimum was $100. He stressed that we were not in Downtown State College, but rather "Patton Township." He also said that they were at the apartment earlier to tell us to turn it off, but no one was there to answer them.
My "nature of offense" is "Defendant, with intent to cause public inconcenience, annoyance, or alarm - makes unreasonable noise."
Not arguing with the officers (who were really just hating my guts at the time,) I took the ticket. He warned that if they have to come back he'll arrest my roomate and I.
My other 2 roomates come back. Starts blasting the music again. I went outside to unplug the thing and tell them that I'll get arrested. THey didn't listen... so as I'm writing this i'm just waiting for the police to come back, if they come back.
But as of now, I have a citation that I'm going to plead not guilty to. Any suggestions?
edit: i'm trying to figure this out because if its around 200, i'll fight it. but theres this $50 "collateral" that I have to give to the court... will I get that back? I know theres a $10 fee that I'm not getting back.
