if you're going to stretch the ToS so broadly as to lump bad or offensive words in the same category as actual obscenity/racism/whatever,

then you should definitely check out the part of the ToS where it bans any sort of content that might, in any way, give rise to civil liability or infringement

(such as a reverse-engineered video game cloned from a copyrighted product)

As of current, I am working on altering the rules to be better aligned with the new word filter. Even without the vBulletin policy crap, I still think the filter is a better option moving forward.

I will likely be completely redoing the infraction policies, as my initial ideas aren't meshing well with how they currently work. I'll also let you know I intend to lessen the harshness by reducing the decay time for lower level infractions (which will result in getting banned only for repeatedly breaking rules in a short time frame)
